General Rules and Policies

AutoBidMaster is a membership-based online auto auction marketplace that provides you with access to the largest auto auction inventory in North America, operated by Copart.
We do not operate the auctions or own the vehicles listed for sale. We simply provide an online platform that allows you to purchase vehicles that are sold by independent third-party sellers through Copart auto auctions.

Our Rules & Policies are intended to provide you with information and resources about our Services, and to promote a fair bidding environment. In addition to our Member Terms and Conditions, the following Rules & Policies govern your use of our Services and your relationship with AutoBidMaster. Therefore, you must review all of our Rules & Policies before you bid to make sure you understand the auction process and the "as is" nature of the vehicles available for purchase through our Services.

Although these Rules & Policies are presented in an informal question-and-answer format, we want to make sure you understand that they are part of the binding, legal agreement that you enter into with us when you review and accept our Member Terms and Conditions. Thus, it is very important that you carefully review all of our Rules & Policies before placing any bids.

Remember, we are merely a marketplace that does not provide any representations, warranties, or guarantees regarding the quality or condition of vehicles listed on our website. We strongly encourage and advise you to inspect any vehicle prior to placing any bid or making any purchase. For more information, please review our Member Terms and Conditions and visit our Help Center.

We want to maintain a fair and enjoyable marketplace, and we want you to be able to bid with confidence. Please review our General Rules & Policies before you bid on any item.

You must register and create an account.

You cannot bid on or purchase any vehicle without first registering and creating your Member Account. As part of the registration process, you must agree to our Agreement, including our Member Terms and Conditions.

You must keep your contact information updated.

We sometimes need to contact you regarding your account and your bidding or purchasing activity, so it is important that you keep your account information accurate and updated. You can update your contact information via your My Account page.

You must educate yourself on the auction process and our Services.

Before you place a bid or buy a vehicle, we strongly advise you to educate yourself on the auction process and our Services.

Primarily, we want to make sure you understand the nature of your transaction with us. Although you ultimately purchase the vehicle from a Dealer (and not from us, Copart, or the auction seller), at the time of your bid the vehicles listed on our website are offered for sale (through Copart auctions) by independent third-party sellers. In other words, the vehicles listed on our website are not owned by us nor in our inventory. Instead, the vehicles listed on our website are available for one of our affiliated dealers (“Dealers”) to buy for the sole purpose of resale to you. The way this works is that when you place a bid on any vehicle using our Services, our software places a corresponding bid directly with Copart on your behalf via one of our Dealers. If your bid is the winning bid, that Dealer is obligated to purchase the vehicle from the auction seller for the amount of your bid (plus applicable fees). More importantly, you are obligated to purchase that same vehicle from the Dealer for the amount of your bid (plus applicable fees).

Please note, we (as the marketplace) may accept different payment methods for memberships than the methods of payment that the Dealer accepts payment on any item purchased. It is your responsibility to review these Rules and Policies to confirm which payment methods are accepted for each product and Service.

In order to fully understand the auction process and our Services, we strongly recommend that you:

- Review our Member Terms and Conditions that you accepted at registration.
- Review our Website Terms of Service.
- Review our Privacy Policy.
- Review our Rules & Policies.
- Get familiar with your My Account page.
- Visit our Help Center.
- Learn How to Buy.
- Learn the terminology with our Glossary.

Please note, all of the foregoing may be updated from time to time.

You must do your own research.

We offer you the opportunity to get some great deals on some great vehicles. But, as you may know, purchasing a vehicle through an online marketplace presents a number of risks. Accordingly, you must do your own research to make sure you get the right vehicle for you. We suggest you research the vehicle in many ways, including reviewing the information provided by Copart, obtaining a ClearVin vehicle report, and doing an inspection of the vehicle prior to bidding.

Although each auction listing includes certain Vehicle Information, including information which may be referred to as Auction Highlights, this Vehicle Information is provided by the auction seller and is for convenience only–meaning we do not independently review or verify any of the information provided, and we provide no representations, warranties, or guarantees regarding the accuracy or completeness of any information in the vehicle listing, including the Vehicle Information.

Primary Damages listed by Copart indicate the initial damage observed by Copart at the time the vehicle as taken into their inventory. A vehicle listed with one type of Primary Damage may have different and or additional types of damage.

Vehicles listed as “Runs and Drives” by Copart are defined by Copart as vehicles which, at the time they were taken into inventory: started, were able to be put into gear, and were able to move forward. There is no guarantee that the vehicle will be able to run, drive, start, and or move forward at the time of sale.

Copart also marks some of their Vehicle as “Copart Select” vehicles. Copart Select vehicles are further broken down into the categories of “Green Light”, “Yellow Light”, and “Red Light”. These “Lights” are intended to be one point of guidance in researching a vehicle, with a “Green Light” being a more positive indicator than a “Yellow Light” and a “Yellow Light” being a more positive indicator than a “Red Light”. AutoBidMaster has no control over which vehicle’s Copart elects to mark this way.

If a Copart Select vehicle was purchased directly from Copart, the type of “Light” a vehicle is marked with would indicate what rights the Copart buyer would have to arbitrate disputes regarding a vehicle, however Copart’s arbitration policy does not apply to vehicles not purchased directly from Copart. AutoBidMaster has a more generous arbitration policy. Please see Section 9 of the Terms and Conditions for more details about our Dispute Resolution Process.

You must obtain a vehicle history report (when available), inspect the vehicle, and do your own research into the condition of the vehicle, the cost of any repairs that may be necessary, and your ability to register the vehicle in your state before placing a bid or purchasing a vehicle.

Please visit our Vehicle Information and Titles FAQ section and Glossary for more information.

You must carefully review any agreement with any of our recommended service providers.

Although we may recommend or refer you to certain third-party service providers for such things as vehicle history reports, inspection services and transportation services, any such service provider is an independent third-party that is not owned or operated by AutoBidMaster. You understand and agree that if you decide to use any of any third-party service providers, your relationship with that service provider is governed by your contract or agreement (if any) with that service provider.

You cannot retract, delete, or cancel your bid for any reason.

Once you submit a bid, it cannot be undone. You should carefully review the amount of your bid before submission.

You must pay for any vehicle you commit to buying.

If you submit a bid in an auction, you are making an unbreakable offer to enter into a binding contract to buy that vehicle from one of our Dealers if your bid is accepted. The same is true if you choose to "Buy it Now."

If you fail to complete your purchase for any reason, we or the Dealer may cancel your transaction and you may be subject to additional fees and charges. In other words, if you do not intend to purchase the vehicle, do not place a bid.

You must be realistic with your expectations.

Many of the vehicles offered for purchase through our website are salvage or otherwise damaged vehicles. These vehicles may have additional or different damage than what is stated on the auction listing and may require substantial repairs at your expense. This is why we strongly recommend that you do your own investigation and research before placing any bid.

Neither we nor our Dealers make any representations, warranties, or guarantees regarding the condition or quality of the vehicles. All vehicles are sold "as is" and "where is" and "with all faults" and without any warranty of any kind, including any implied warranty of merchantability or fitness for a particular purpose.

Please carefully review the disclaimers in our Member Terms and Conditions for more information.

You must notify our Buyer Services Team of any problems before the vehicle leaves the Copart facility.

Once your vehicle leaves the Copart facility (or other location where your vehicle is awaiting pickup), you accept your vehicle "AS IS" and "WHERE IS" and "WITH ALL FAULTS". Any claims that the vehicle does not match the auction listing or any other claims regarding the vehicle, must be brought to the attention of Buyer Services before the vehicle leaves the Copart facility (or other location where your vehicle is awaiting pickup).

Please visit our Help Center for more information.

Security Deposit Rules & Policies

You must submit a Security Deposit to activate your Member Account.

You must submit and maintain a security deposit ("Security Deposit") of at least Six Hundred Dollars ($600) at all times to keep your Member Account active. Your initial Security Deposit of no less than Six Hundred Dollars ($600) is required before you are able to bid on any vehicle.

Your Security Deposit may be paid by with the following payment options.

You may pay your Security Deposit by Credit Card, Debit Card, Apple Pay, Google Pay, MoneyGram, Zelle, or by sending a Wire Transfer for the amount.

Your Security Deposit amount determines your Buyer Power.

For Advanced Memberships and Premium Memberships, your Security Deposit represents 10% of your maximum bid ("Buyer Power"). For example, the minimum Security Deposit of Six Hundred Dollars ($600) enables you to bid up to Six Thousand Dollars ($6,000). For Guest Memberships and Basic Memberships, the minimum Security Deposit is still Six Hundred Dollars ($600), however the maximum bid amount for Guest Members is Two Thousand Dollars ($2000), and the maximum bid amount for Basic Members is Three Thousand Five Hundred Dollars ($3,500).

You must submit an additional Security Deposit if you want to bid on more than one vehicle.

The minimum Security Deposit allows you to be the current high bidder on a maximum of one (1) vehicle at any given time. If you wish to bid on more than one (1) vehicle at any given time, you must submit a separate Security Deposit for each additional vehicle.

You must increase your Security Deposit to increase your Buyer Power.

Advanced Memberships and Premium Memberships do not have any limitations on bid amounts. If you have an Advanced or Premium Membership and you wish to place a bid in an amount higher than the initial Six Thousand Dollars ($6,000) of Buyer Power, you must increase the amount of your Security Deposit via your My Account page.

If you have a Guest or Basic Membership and you wish to place a bid in an amount higher than allowed by your membership, you must upgrade your membership accordingly. Once you have an Advanced Membership or a Premium Membership, the Buyer Power available, based on the minimum Security Deposit of Six Hundred Dollars ($600), is Six Thousand Dollars ($6,000). If you wish to place a bid in an amount higher than Six Thousand Dollars ($6,000), then you must increase the amount of your Security Deposit, as indicated above.

Keep in mind that you may not be able to increase your Security Deposit during an auction if the bids exceed your limit, so remember to add a high enough Security Deposit before the auction begins.

Please visit your My Account page to manage your Security Deposit.

You may need to reauthorize your Security Deposit if made by Credit Card.

If you make your Security Deposit by Credit Card, we may place a temporary "hold" in the amount of your deposit rather than charging this amount to your Credit Card. This "hold" appears on your Credit Card account as a pending transaction, but you do not actually pay us this money. Depending on your Credit Card company, this "hold" may expire after a certain amount of time (e.g., 30 days). As a result, you may need to reauthorize the "hold" in order to maintain your minimum Security Deposit and keep your Member Account active. If you have saved your Credit Card on file with us, your Security Deposit will automatically be renewed.  We will notify you via email and in your My Account page if your Security Deposit is no longer valid.

We may change the requirements for your Security Deposit for any reason.

We may change the requirements for your Security Deposit at any time for any reason. This includes without limitation raising the minimum Security Deposit amount, changing how your Buyer Power is calculated, and changing the accepted forms of payment.

You cannot pay for your vehicle with your Security Deposit.

You cannot use your Security Deposit to pay for any vehicle (or any portion thereof), but we may (in our sole discretion) use your Security Deposit to pay for unpaid amounts.

However, if your Security Deposit was made by wire transfer, we may (in our sole discretion) apply any or all of your Security Deposit to the unpaid purchase price of any vehicle or any unpaid fees.

See our Payment Rules & Policies for more information.

We may use your Security Deposit to pay for unpaid fees.

If you have any unpaid fees to us or our Dealer(s) for any reason, you agree that we may (in our sole and absolute discretion) use your Security Deposit to pay for the unpaid amount. By utilizing our Website, Products, and Services, you expressly authorize us to charge your Credit Card for all amounts owed to us or one of our Dealers, even if it exceeds the amount of your existing Security Deposit.

Your Security Deposit will be released/refunded upon request.

We will release/refund your Security Deposit upon your request if:

- You do not have an unpaid account balance with us or any of our Dealers;
- You do not have any pending bids or transactions; and
- You are not in violation of our Member Terms and Conditions.

Security Deposit release/refund requests must be submitted via your My Account page and a confirmation number must be obtained.

Once your Security Deposit is released/refunded, you will no longer be able to bid on vehicles.

You may not receive an actual "refund" if your Security Deposit was made by Credit Card.

If you make your Security Deposit by Credit Card, we may place a temporary "hold" in the amount of your deposit rather than charging your Credit Card. This "hold" appears on your Credit Card account as a pending transaction, but you do not actually pay us this money. Therefore, to "refund" your Security Deposit, we simply release the "hold" and the pending transaction is removed. If you request a refund of your Security Deposit, and we have removed the “hold” on your account, we do not have any control of how quickly your bank will show those funds available in your account. Depending on your bank, this may take up to one statement cycle for the pending transaction to be removed.

Other Security Deposits refunds.

If the Security Deposit payment was made by any other form of payment than a Credit Card, the member’s registered address is in the United States, and the Security Deposit came from the member, the member must provide their routing and account numbers in order for the Security Deposit to be refundable. Such refunds will be made by ACH transfer. If the Security Deposit payment was made by any other form of payment than a Credit Card, the member’s registered address is in the United States, and the Security Deposit came from anyone other than the member, the member must provide a voided check for the payor’s checking account, in order for the Security Deposit to be refundable. Such refunds will be made by ACH transfer. If the member who paid the Security Deposit does not have a bank account, or the third party who paid the Security Deposit on a member’s behalf does not have a “voided” check, please contact us to make other arrangements for potential Security Deposit refunds.

If the Security Deposit payment is made by any other form of payment other than a Credit Card and the member’s registered address is outside the United States, the refund will be issued by wire transfer. Please allow up to thirty (30) business days for all refund and release processing.

Please see our Help Center and Security Deposits FAQ section for more information.

Bidding Rules & Policies

We want to maintain a fair and enjoyable marketplace for our members. So, before you start bidding, we ask that you review and understand the following:

- Member Terms and Conditions
- Rules & Policies
- Website Terms of Service
- Privacy Policy

We also ask that you review the following tips and information on how to use our website and Services:

- Help Center
- How to Buy
- Glossary

If you have any questions, please contact our Buyer Services Center at hello@autobidmaster.com or +1 (503) 298-4300 before you bid.

Remember, we are merely a marketplace that does not provide any representations, warranties, or guarantees regarding the quality or condition of vehicles listed on our website. We strongly encourage and advise you to inspect any vehicle prior to placing any bid or agreeing to purchase any vehicle.

You agree that you cannot retract, delete, or cancel any bid for any reason.

You agree that you are obligated to pay the amount of any bid (plus all applicable fees) that you submit or authorize (or is otherwise submitted or authorized through or under your Member Account) if your bid is accepted. This includes all bids placed during the Preliminary Bidding Period and the live Virtual Auction and applies regardless of how or where your bid is placed.

You understand that Copart may reject your bid.

Copart (as operator of the auction) may in its sole discretion reject or cancel any bid at any time and for any reason without prior notice to you or AutoBidMaster. You acknowledge and agree that any such rejection or cancelation is not within our control or discretion, and hereby release us from any related liability, damages, and losses. Please review our general release in our Member Terms and Conditions for more information.

You understand that We, one of our Dealers, or Copart may cancel a sale.

AutoBidMaster, one of our Dealers, or Copart, as the operator of the auction, may postpone, cancel, unwind, or withdraw a vehicle from a sale at any time and for any reason without prior notice. You acknowledge and agree that any such postponement, unwinding, cancellation, or withdrawal may not be within our control but even when it is, you hereby release AutoBidMaster, our Dealers, and Copart from any related liability, damages, and losses, specifically to include any additional cost you incurred related to the vehicle and or it’s purchase. Please review our general release in our Member Terms and Conditions for more information.

You may use the Bid4U system to make the bidding process easier and more efficient.

Copart, as the operator of the auction, may use a Bid4U system that allows bidders to enter a preliminary bid amount representing the maximum price you are willing to pay for a given vehicle, and the Bid4U system will place incremental bids (up to your maximum bid amount) on your behalf during the Preliminary Bidding Period and the live Virtual Auction. The Bid4U system will only bid in one increment above the current high bid in order to maintain your position as the high bidder, which may allow you to purchase a vehicle for less than your maximum bid. If the current high bid exceeds your maximum bid, you will be notified via email, and if there is enough time remaining in the auction, you may increase your maximum bid. Bid4U may not be available for all auctions.

Just as with any other bid, once you place a bid via the Bid4U system, the bid is binding and cannot be canceled or retracted.

Bids made during the live auction prevail over pre-auction bids of the same amount.

Bids made during the live Virtual Auction will prevail over any bids made during the Preliminary Bidding Period of the same amount. For example, if you submit a maximum bid of One Thousand Dollars ($1,000) during the Preliminary Bidding Period and someone places a bid of One Thousand Dollars ($1,000) during the live Virtual Auction, you will lose unless you increase your bid amount during the live Virtual Auction.

Please review our How to Buy tutorial for more information.

If you choose to "Buy It Now," or “Make An Offer” you are obligated to purchase the vehicle at the price stated.

Certain vehicles are offered for sale with a "Buy It Now" option that allows you to purchase the vehicle immediately at a price set by the auction seller before the vehicle goes up for auction. If you select the Buy It Now option, you are obligated to purchase the vehicle for the stated auction price plus AutoBidMaster Fees, Copart Fees, and other fees as outlined in the Terms and Conditions to which you agreed. You cannot retract, delete, or cancel a Buy It Now bid for any reason.

Certain vehicles are offered for sale with a “Make An Offer option that allows you to make an offer on a vehicle to the auction seller before the vehicle goes up for auction. If you selected the Make An Offer option, you are making a binding offer to purchase the vehicle for the amount offered to the seller at the auction, plus AutoBidMaster Fees, Copart Fees, and other fees as outlined in the Terms and Conditions to which you agreed. You cannot retract, delete, or cancel an amount offered on a Make An Offer for any reason.

Your high bid is binding even if the seller submits a counteroffer.

You acknowledge and agree that even if the seller makes one or more counteroffers, these counteroffers do not change the binding nature of your high bid, Buy It Now, or Make An Offer on any vehicle. Your high bid amount to the seller is an offer that cannot be revoked or cancelled and shall remain open to acceptance by the seller until 8:00 pm (Pacific) on the next business day after the auction date.

For example, you bid Five Thousand Dollars ($5,000) on Vehicle A and your bid is the highest bid at the end of the auction. After the auction ends, the seller makes a counteroffer of Six Thousand Dollars ($6,000). Even if you do not accept the seller's counteroffer of Six Thousand Dollars ($6,000), the seller may still accept your high bid of Five Thousand Dollars ($5,000) before 8:00 pm (Pacific) on the next business day. You may not revoke or cancel your bid, even if the seller makes one or more counteroffers.

You agree that your high bid is not accepted or rejected unless or until you receive notification from us of the same. You agree that the acceptance or rejection of your bid for an "On Minimum Bid" vehicle is not within our control or discretion and hereby release us from any related liability, damages, and losses. Please review our general release in our Member Terms and Conditions for more information.

You understand that certain vehicles are sold "On Approval."

Even if you placed the high bid, you have not purchased the vehicle, if the vehicle is sold "On-Approval" unless and until Copart (as the operator of the auction) notifies us of acceptance of your bid. In some instances, it may take up to 3 business days (including the auction date) for the seller of an "On-Approval" vehicle to provide Copart with notice of acceptance of a bid.

You agree that your bid is not accepted or rejected unless or until you receive notification from us of the same, even if you do not receive such notice within 3 business days. You agree that the acceptance or rejection of your bid for "On-Approval" vehicles is not within our control or discretion and hereby release us from any related liability, damages, and losses. Please review our general release in our Member Terms and Conditions for more information.

You understand that certain vehicles are sold "On Minimum Bid."

A vehicle sold "On Minimum Bid" means that the seller established a minimum bid or reserve price before the auction. If you are the high bidder and your high bid meets or exceeds the minimum bid, you will be obligated to purchase the vehicle at the end of the auction. However, if you are the high bidder but your bid does not meet or exceed the minimum bid, you will not be awarded the vehicle at the end of the auction. Instead, once the auction ends, you have the option to: (a) maintain your high bid or (b) increase your high bid. Additionally, the seller has the option to: (a) accept your high bid, (b) reject your high bid, or (c) make a counteroffer.

Our Win Guarantee helps you increase your chances of winning vehicles listed as “On Approval” or “On Minimum Bid.”

With our Win Guarantee, you authorize us to negotiate directly with the seller to purchase the vehicle for an amount less than or equal to your maximum bid or the seller's reserve price (whichever is less), plus applicable fees. We will negotiate in small increments in an effort to obtain the best possible price for resale to you.

You cannot bid on your own item.

We may offer consignment sales for certain vehicles. If you consign a vehicle for sale, you may not bid on this item. We call this "shill bidding" and it is a violation of our policies and is against the law in many states.

Similarly, if you know the seller of the vehicle, you cannot bid on the vehicle for the purpose of driving up the selling price. This rule applies to family, friends, partners, roommates, coworkers, employees, and others.

You can visit the Copart yard and inspect or preview a vehicle.

During any Preliminary Bidding Period (which ends one (1) hour before the live auction), you may be able to preview and/or inspect any vehicle offered at a scheduled sale at a Copart facility in person. Copart may charge a fee for you to enter the Copart facility to preview or inspect a vehicle. It is your responsibility to determine your ability to preview or inspect any vehicle and the type and amount of any related fees prior to arriving at the Copart facility.

You agree that your ability to preview or inspect a vehicle and the type and amount of any related fees charged by Copart are beyond our control. Accordingly, you hereby release us and our Dealers from any related liability, damages, and losses. Please review our general release in our Member Terms and Conditions for more information.

The title you may receive might be different than the title or ownership document state and type that is listed on the lot listing page.

Due to variations in applicable law, you may receive a title or ownership document which is different than the title or ownership document that is listed on the lot listing page if purchasing a vehicle from out of state. For example, depending on your location, if you are an Idaho resident and you purchase a vehicle that is currently located in Nevada, you may receive an Oregon salvage certificate of title. Processing times for different (but similar) titles or ownership documents may take five to seven weeks and result in additional fees.

Special requirements for California Residents:

If you are a California resident, you can purchase vehicles through our Service, following our usual process, so long as the vehicle you are purchasing is not located in California. If you are a California resident and the vehicle you wish to purchase is currently located in California, there is a different process that needs to be followed since we do not sell vehicles in California. All bids placed via our online membership marketplace will be fulfilled by a Dealer. All payments will be made via our online membership marketplace, on behalf of the Dealer. Our affiliated Dealer will sell the vehicle to you and will provide the related sale paperwork, as detailed below. All purchases processed to California residents via our Dealers will include California sales tax.

If a California resident purchases a vehicle which is located in California, the purchaser will not receive the title as listed on the lot listing page. Instead, the buyer will receive an Acquisition Bill of Sale. An Acquisition Bill of Sale may be revived into a salvage title when you register the vehicle with the State of California. The vehicle will have to pass various inspections before it can be registered. Please note that we do not assist with repairs, registrations, or inspections. Whether a vehicle sold with an Acquisition Bill of Sale is registerable in the various states is a determination made by the states and as such, we do not guarantee that a vehicle sold with an Acquisition Bill of Sale will be registerable.

If a California resident wishes to purchase a vehicle in California which is listed as having a non-repairable title, that vehicle cannot be registered in California.

If a California resident wishes to purchase a vehicle in California for export, please let us know prior to bidding on any vehicle. In order for a California resident to purchase a vehicle in California for export, the buyer must have a clean title in their name and an Acquisition Bill of Sale is not acceptable as clean title for export. By letting us know prior to bidding, we can provide you with a clean title marked for Export Only.

Payment Rules & Policies

We have very specific rules and policies related to the timing and methods of payment. We want to make sure that you understand and are prepared to complete your transaction, so please review the following rules and policies carefully before bidding.

You are responsible for knowing the type and amount of all applicable auction fees before bidding.

All vehicles purchased using our Services are purchased via a Dealer (not our marketplace) and all purchases are subject to certain auction fees charged by AutoBidMaster ("AutoBidMaster Fees") and by Copart ("Copart Fees") (collectively "Auction Fees"). The type and amount of applicable fees is available here. You may also use our Fees Calculator on each lot listing page to see an estimate of your total purchase price (including all Auction Fees) based on your bid amount before you place your bid.

The Auction Fees apply to each vehicle you purchase using our Services. You are responsible for knowing the type and amount of fees that apply before placing your bid.

The Fees Calculator available on the lot listing page provides an estimate only.

Each lot listing page includes a Fees Calculator to help you decide whether and how much to bid on any given vehicle. We try to include all applicable fees and taxes in our Fees Calculator, but due to the variability in the type and amount of fees and taxes that may apply to any given transaction, we cannot guarantee that the Fees Calculator is accurate or complete. As a result, it is your responsibility to determine the total purchase price for any vehicle based on your bid amount, and you acknowledge and agree that you are obligated to pay the full amount stated on your invoice even if it does not match the estimate provided by the Fee Calculator. If you dispute the amount on your invoice, you must notify us before you pay. You acknowledge and agree that once you pay your invoice, there are no refunds for any reason, and you have waived your right to dispute the amount.

You must pay all sales, consumption, and use taxes related to your purchase of any vehicle using our Services.

You must pay all sales, consumption, use, and other applicable taxes charged by any local, state, and federal governing body or taxing authority that are based on your purchase of any vehicle from us.

Additionally, you must reimburse us for all sales, consumption, use, and other applicable taxes charged by any local, state, and federal governing body or taxing authority that are based on our purchase of any vehicle from an auction seller for resale to you.

You are responsible for determining the type and amount of any such taxes before placing your bid.

You must repay us for any sales tax if purchasing vehicles at wholesale.

If you are purchasing vehicles from one of our Dealers at wholesale pursuant to a sales tax exemption certificate, you agree to repay and defend AutoBidMaster and the Dealer from any and all damages or losses of any kind (including without limitation sales tax assessments, fines, penalties, damages, and other costs or expenses, including attorney fees), incurred as a (direct or indirect) result of a determination, decision, or ruling by any taxing authority that the transaction was subject to the payment of sales, use, excise, or other applicable tax.

You must pay by Wire Transfer, MoneyGram, or Zelle.

Payment for the purchase of any vehicle (including applicable Fees) must be made by one of our available payment methods, which include Wire Transfer, MoneyGram, or Zelle, only. No other payment methods are accepted. Note, occasionally for circumstances beyond our control, one or more payment method might not be available. If that is the case, payment will need to be made by one of the other available payment methods. If you make or attempt to make payment by any other method, we reserve the right to cancel your purchase and relist the vehicle (see below).

Please visit our Help Center and Paying for Vehicles Help section for more information, including how to make a wire transfer.

You must pay on the next business day after we send you an invoice.

Payment for your purchase of any vehicle (including applicable Auction Fees) must be received before 5:00 pm (Pacific) on the next business day after the sale date. A "business day" is any weekday that is not a US federal holiday. (Note: International customers must pay by 5:00 pm (Pacific) on the second business day after the sale date.)

Please visit our Help Center and Paying for Vehicles FAQ section for more information, including how to make a wire transfer and wire transfer processing fees that may apply.)

You will be charged Late Fees if you do not pay on time.

In the event your full payment for the purchase of any vehicle (including applicable Auction Fees) is not received before the payment deadline, you must pay late payment fees ("Late Fees"). The type and amount of applicable fees is available here.

You will not be charged any Late Fees after your purchase is canceled and the vehicle is relisted (see below) or after your vehicle is declared abandoned (see Vehicle Pick Up Rules & Policies). You authorize us to automatically charge those Late Fees to any payment method utilized with our Services.

Please visit our Help Center and Paying for Vehicles FAQ section for more information.

You will be charged Storage Fees if your vehicle is not picked up on time.

If any vehicle you purchase using our Services is not removed (see Vehicle Pick Up Rules & Policies) from the Copart facility (or other location where your vehicle is awaiting pickup) ("Facility") within the time limit set by that Facility, you must pay vehicle storage fees ("Storage Fees"). The number of days you have before you begin incurring fees (3-5 days after the auction), and the amount of those fees (up to forty dollars ($40) per day), will vary based on each Facility’s policies. It is your responsibility to review the Facility’s Storage Fees prior to bidding on any vehicle. All fees are part of the amount due for the vehicle and no vehicle may be picked up if it is not paid for in full.

You acknowledge and agree that Storage Fees are charged by Copart (as the operator of the auction and owner of the lot where the vehicle is stored) in the amount of the Storage Fees that You are charged. You agree that the Storage Fees are reasonable and are not a penalty or “liquidated damages” but instead represent the actual amount of losses that we will incur in the event that you fail to complete your purchase transaction.

You will not be charged any Storage Fees after your vehicle is declared abandoned (see Vehicle Pick Up Rules & Policies).  If you have saved your Credit Card on file with us, you authorize us to automatically charge those Storage Fees to that Credit Card.

You must pay your transaction fee even if you do not complete your purchase.

If you do not complete your purchase transaction (by failing to pay or for any other reason) before the payment deadline, you acknowledge and agree that you still must pay your Transaction Fee, in addition to any other relevant fee(s). The amount of the Transaction Fee depends on your membership level and is available here.

You will be charged Relist Fees if you do not complete your purchase.

If you do not complete your purchase transaction (by failing to pay, failing to pay in full, or for any other reason) before the payment deadline, you acknowledge and agree that we or our Dealer will cancel your purchase and request that Copart relist the vehicle for sale through the auction. If this occurs, you must pay the applicable relist fees ("Relist Fees"). The Relist Fee is the sum of Copart’s Fee plus the Transaction Fee. The type and amount of applicable fees is available here.

All Relist Fees must be paid by wire transfer or by Credit Card and are due at 5:00 pm (Pacific) on the next business day after the auction end date. If you do not pay your Relist Fees by the applicable deadline, you may incur Late Fees.

You acknowledge and agree that Copart (as the operator of the auction) charges our Dealers fees in the amount as indicated in the calculation of the Relist Fees, and that you are responsible for payment of both Copart’s Fee and the Transaction Fee. You agree that these Fees are reasonable and are not a penalty or “liquidated damages” but instead represent the actual amount of losses that we will incur as a direct result of your failure to complete your purchase transaction.

We reserve the right to apply payments received to pre-existing unpaid account balances.

You acknowledge that we or our Dealers may (in our sole discretion) bill your Credit Card for, and or apply all or any portion of your wire transfer (or any other) payment amount (regardless of your intended or specified purpose) to any pre-existing unpaid account balance (including without limitation unpaid Membership Fees, Auction Fees, Storage Fees, Late Fees, Relist Fees, and other applicable fees) before applying it to the purchase price for any vehicle purchased using our Services.

For example, if you make a wire transfer payment of One Thousand Dollars ($1,000) for the purchase of Vehicle B, but have an unpaid balance of Relist Fees in the amount of Six Hundred Dollars ($600) related to Vehicle A, we may first apply the Six Hundred Dollars ($600) of your One Thousand Dollars ($1,000) payment toward the unpaid Relist Fees for Vehicle A, with the remaining Four Hundred Dollars ($400) applied toward payment for purchase price of Vehicle B, with a remaining balance owed on Vehicle B of Six Hundred Dollars ($600). You may be subject to Late Fees and Storage Fees until the remaining balance for Vehicle B is paid in full. Additionally, if Vehicle B is not paid in-full, we may cancel the sale and relist Vehicle B, in which case we may deduct the applicable Relist Fees and any other unpaid amounts from your payment balance and refund you the difference (if any).

Regardless of how your payment is applied, you acknowledge and agree that we have no duty or obligation to release any vehicle or any vehicle title or ownership document to you if you have an unpaid account balance with us or any of our Dealers (see below).

If you do not pay us, one of our Dealers may apply for a title on your behalf and place a lien on your vehicle.

You are responsible for the full payment of all fees and charges incurred by you in connection with your use of our Services. If you fail to pay any amount owed for any reason, you agree that one of our Dealers may complete and submit an Application for Title and Registration (or other appropriate form) on your behalf that lists that Dealer as a security interest holder to secure our right to payment. To facilitate this process, you must sign a Limited Power of Attorney document (included in your sale documents) that authorizes us act as your representative and to sign your name to any forms necessary concerning the titling or registration of your vehicle. You expressly acknowledge and agree that our authority under this Power of Attorney includes the authority to sign your name (or on your behalf) to agree to a lien on your vehicle for any unpaid amount owed to us related to your purchase of the vehicle. If you fail to sign this Limited Power of Attorney document, we may cancel your purchase transaction and hold you liable for the associated Fees.

Accordingly, by signing the Power of Attorney and purchasing any vehicle using our Services, you expressly grant the Dealer a security interest in that vehicle, which we may perfect in accordance with ORS 803.097. You acknowledge that this lien may prevent you from selling or transferring the vehicle or from titling or registering the vehicle in another state or jurisdiction.

Moreover, you acknowledge that we may foreclose on our security interest if you do not pay the full amount owed.

If you do not pay us, we may send you to collections.

You are responsible for the full payment of any and all fees and charges incurred by you in connection with your use of our Services. If you fail or refuse to pay any amount owed for any reason, and we refer your past due account to a third-party for collections purposes, you agree that we may add the reasonable collections fee of at least One Hundred Dollars ($100) to the original amount owed.

We may suspend your Member Account or revoke your bidding privileges if you have an unpaid balance.

You acknowledge and agree that we may (in our sole and absolute discretion) suspend your Member Account or otherwise revoke your bidding privileges if you have an unpaid account balance with us or any of our Dealers.

The "sale date" for any vehicle You purchase is the date on which You take possession of the vehicle.

You acknowledge and agree that the "sale date" for any vehicle You purchase using our Services is the date on which You take possession of the vehicle, and not the auction date or the date on which your bid is accepted. Because you are prohibited from picking up the vehicle yourself, this means that the "sale date" will likely be the date on which your vehicle is picked up by the transporter hired to deliver your vehicle to you. (See Delivery Rules and Policies.)

The Dealer will transfer ownership of your vehicle to you after the sale date.

Upon acceptance of your bid by the auction seller, Copart (as the operator of the auction and authorized agent of the seller) will transfer or reassign (as applicable) the vehicle's title or ownership document to the Dealer. If the seller or Copart do not timely provide the Dealer with the ownership documents, they will not be able to timely provide them to you. You understand and acknowledge that ownership documents may be delayed by circumstances beyond our control or the control of our Dealer, and you release us and the Dealer from all liability for the untimely transfer of these documents which is outside of our control. Upon their receipt of the ownership documents, the Dealer will transfer or reassign (as appropriate) the vehicle's title or ownership document to you.

We may use a separate entity to transfer or reassign your vehicle's title or ownership document to you.

Due to variations in applicable law, the title or ownership document for your vehicle may be transferred or reassigned (as applicable) by a Dealer or another third-party agency.

There may be delays in the transfer or reassignment of your vehicle's title or ownership document that are unavoidable or beyond our control.

You acknowledge that, due to the nature of the transactions involved in this type of sale, there may be delays in our transfer or reassignment of the title or ownership document to you that are unavoidable or beyond our control. As a result, you may not receive your title or ownership document within the time limit (if any) specified by applicable law. In the unlikely event that there is a delay, the Dealer will do their best to notify you and update you on the status.

The Dealer will only transfer ownership to you.

Under no circumstances will the title or ownership document of any vehicle be transferred or assigned to any person or entity other than you.

You are responsible for transfer of ownership and registration.

Except where we submit an application for title on your behalf, you are responsible for the transfer of ownership of your vehicle (including without limitation registration in your name, if applicable) and hereby release us from and agree to defend and indemnify us against any related liability, damages, and losses. Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

We or our Dealer may refuse to release any vehicle or ownership documents if you have an unpaid account balance or have violated any of our terms.

You agree that we have no duty or obligation to release any vehicle or any vehicle title or ownership document, even if you have sent full payment for the purchase price and applicable Auction Fees related to the vehicle at issue, if (a) you have not submitted your signed sale documents; (b) you have an unpaid account balance (related to this vehicle or otherwise); or (c) you are in violation of our Member Terms and Conditions.

For example, if you purchase Vehicle A for One Thousand Dollars ($1,000) (including the purchase price and applicable Auction Fees) and send a wire transfer to us in this amount, but you have a pre-existing unpaid account balance of Five Hundred Dollars ($500) related to unpaid Relist Fees for Vehicle B, we have no duty or obligation to release Vehicle A to you (even though you may believe that you have paid for Vehicle A) until you pay your unpaid account balance of Five Hundred Dollars ($500).

You may be subject to Late Fees and Storage Fees until the remaining account balance is paid in full. Additionally, if your unpaid account balance is not paid in full, we may cancel the transaction and relist Vehicle A, in which case we may deduct the applicable Relist Fees and any other unpaid amounts from your payment balance and return you the difference (if any) to you.

Other than as provided herein under Membership Refund Policy, there are no refunds for any reason.

You agree that due to the non-cancelable and irrevocable nature of the vehicle purchase transaction(s) entered into using our Services, all fees and charges (including without limitation any vehicle purchase price, Membership Fees (outside of the limited exclusions provided in the Membership Refund Policy), Auction Fees, Storage Fees, Late Fees, Relist Fees, and other applicable fees) are non-refundable, and no refund will be processed for any reason.

We repeat, other than the limited situations where memberships may be refundable: No refunds for any reason.

Please visit our Help Center and Paying for Vehicles FAQ section for more information.

Delivery Rules & Policies

You must use an approved transporter to pick up your vehicle.

No vehicle may be driven away from the Copart facility (or other location where your vehicle is awaiting pickup). Unless the vehicle you purchased is located in the same state as your address in our membership records, you must arrange for your vehicle to be picked up (or otherwise removed) from the Copart facility (or other location where your vehicle is awaiting pickup) by an approved transporter. If the vehicle you purchase is located in the same state as your address in our membership records, you will be automatically enrolled in AutoBidMaster Home Delivery. With AutoBidMaster Home Delivery, AutoBidMaster or an AutoBidMaster affiliated entity will deliver the purchase to you, for an additional fee. All purchases from in-state auctions require AutoBidMaster Home Delivery.

Auction lot locations.

Due to variations in applicable law or the operating procedures of our vendors, your shipping company may be required to pick up your vehicle from a location other than the Copart lot where the vehicle was located at the time of the auction. For example, even if a vehicle is located at a Copart lot in Sacramento, CA, at the time of the auction, your pickup location may be Portland, OR. This may result in longer delivery times and additional delivery costs.

Unless your vehicle is located in the same state as on your membership account, you must arrange for your vehicle to be picked up by a shipping company within 10 days.

If a vehicle is not removed from the Copart facility (or other location where your vehicle is awaiting pickup) within ten (10) days from the date bid acceptance (regardless of payment status and for whatever reason), you acknowledge and agree that we may (in our sole and absolute discretion) declare the vehicle ABANDONED.

We have the right to sell an abandoned vehicle.

You agree that once a vehicle is declared abandoned, one of our Dealers has the right to sell the vehicle at auction (or in any other commercially reasonable manner). Upon the sale of the abandoned vehicle, we will deduct from the proceeds the reasonable costs and expenses of the sale and any unpaid account balance you have and then disburse the remainder (if any) to you.

You agree that the sale of an abandoned vehicle through an auto auction (operated by Copart or otherwise) is a commercially reasonable method of sale (regardless of the amount of the sale price) and further agree that we have no obligation to place a minimum or reserve price on the vehicle. You hereby release us and our Dealer, from any liability, damages, and losses related to the sale of any abandoned vehicle. Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

We and our Dealers reserve the right not to release any vehicle to you.

You agree that we have no duty to release any vehicle to you (or the shipping company) if you have an unpaid account balance (including without limitation vehicle purchase price, Membership Fees, Auction Fees, Storage Fees, Late Fees, Relist Fees, and other applicable fees related to this vehicle or otherwise) or are otherwise in violation of our Agreement.

You assume all risk of loss for any vehicle you purchase.

Beginning from the time Copart (as the operator of the auction) or the auction seller accepts your bid, you acknowledge and agree that the Copart facility (or other location where your vehicle is awaiting pickup) is acting as bailee of your vehicle until such time as the vehicle is removed from the Copart facility (or other location where your vehicle is awaiting pickup). You agree that under the terms of this bailment, neither AutoBidMaster, our Dealers, nor Copart is liable for damage to or loss of your vehicle (or any portion or parts thereof) due to operational procedures in place at the Copart facility (or other location where your vehicle is awaiting pickup), acts of theft or vandalism, weather, acts of God, or any other reason.

AutoBidMaster and our Dealers are released in full from any and all liability once your vehicle is removed from the Copart facility.

Once your vehicle is removed (whether it is removed by you or by anyone acting on your behalf) from the Copart facility (or other location where your vehicle is awaiting pickup), you accept the vehicle "AS IS" and "WHERE IS" and "WITH ALL FAULTS". Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

Neither AutoBidMaster nor our Dealers are responsible for any damage to your vehicle during shipping.

Neither AutoBidMaster nor our Dealers are liable or responsible for (a) any damage to or loss of your vehicle (or any part thereof) that occurs in transit, (b) your vehicle after it has been delivered to your specified location, or (c) any discrepancy between the vehicle purchased through our Services and the vehicle delivered.

You understand and assume all risk of loss for any vehicle requested to be transported by any third-party service provider to which we may refer You. Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

When your vehicle is being picked up and transported, you are responsible for your and the shipper’s compliance with all applicable laws, rules, and regulations.

You agree to comply, and to cause your agents and representatives (if any) to comply, with all applicable laws and regulations when they remove your vehicle from a Copart facility (or other location where your vehicle is awaiting pickup), including without limitation properly loading and securing your vehicle for safe travel. Copart personnel may load or assist in loading your vehicle at your request, but under no circumstances will AutoBidMaster, our Dealers, or Copart have any liability whatsoever for any damages or losses of any kind arising out of or in any way related to the loading and/or securing of your vehicle for transport. Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

You agree that we may provide your Member Account information to service providers.

We can help you arrange for the transport and delivery of your vehicle to your destination by connecting you with our recommended third-party service providers. You agree that we may provide your Member Account information (including without limitation your contact information) to any third-party service provider to which we may refer you for shipping, transportation, or logistical services. Please see our Privacy Policy for more information on how you can manage your data and communication preferences.

Please visit our Help Center for more information.

Separate Rules Governing International Sales and Transportation

Ownership of the automobile on which you have successfully bid or acquired through us does not transfer until arrival of your automobile at the international port of delivery. You are responsible for the transfer of ownership of your vehicle (including without limitation registration in your name, if applicable) and hereby release us from and agree to defend and indemnify us against any related liability, damages, and losses. Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

The Storage Fee charge that is incurred if buyers do not promptly remove a vehicle from the Copart. No buyer may pick up a vehicle directly from any auction yard. You do assume responsibility for picking up the vehicle from the international port of delivery.

The “Sale Date” for any vehicle you purchase is the date on which you take possession of the vehicle at the international port of delivery. The “Sales Date” is not the date on which your vehicle is picked up by the transporter for delivery to you but instead, the date of arrival of the automobile at the international port of delivery.

Once your vehicle arrives at the international port of delivery, you accept the vehicle “AS IS” and “WHERE IS” and “WITH ALL FAULTS.” Please review our general release and indemnity provisions in our Member Terms and Conditions for more information.

Transportation of the vehicle by ocean is subject to the provisions of the Carriage of Goods by Sea Act of the United States, 46 U.S.C. sections 1300-1315 (hereafter, "COGSA"), and all limitations of damages set forth therein.
